Executive Summary
Grant Ford is a Partner and head of our Litigation and Insolvency practice. Grant has extensive experience in most areas of litigation. His focus areas are commercial litigation; insolvency/business rescue (US Chapter 11 and 7 equivalent); commercial property disputes; banking and finance and general corporate recovery work.
Grant has been involved in various insolvency enquiries and High Court litigation and has significant arbitration experience (AFSA and Arbitration Act) as well as experience in international arbitrations (LCIA and others) – including in London and Mauritius.
Grant assists various business rescue practitioners with business rescue processes and litigation on the one hand and on the other hand also works with various financial institutions and major banks during business rescue processes.
Grant’s experience includes:
- acting for Old Mutual Properties in various commercial property disputes
- being involved in the Marriott International acquisition of Protea Hotels
- acting for Nedbank, Old Mutual Group, Remgro and Protea Hotels
- acting for the Fidentia curators in supervising the asset recovery process as well as Fidentia’s litigation and enquiry processes
- acting for the Western Province Cricket Association in High Court and arbitration proceedings against Cricket South Africa
- representing various national landlords and tenants regarding rights and obligations under current COVID-19 Disaster Management Act Regulations and lockdown
- advising on business interruption claims against various national insurers
- representing a critical services supplier creditor in SAA Business Rescue
- representing a national major creditor in Edcon Business Rescue
Career
Grant was articled to Herbsteins Inc and became a director of that firm in 1996. More recently he was a director of Cliffe Dekker Hofmeyr Inc and regional head of litigation until joining Bernadt Vukic Potash & Getz as a Partner in August 2018 and is a member of the Association of Insolvency Practitioners of South Africa.
Market Recognition
Best Lawyers International (an international peer review publication) listed Grant in the following 3 categories: Arbitration and Mediation; Litigation and Insolvency and Reorganization Law for the years 2015 – 2023.
In addition, Grant was voted as “lawyer of the year” for his work in in Arbitration and Mediation in Cape Town (2020), and “lawyer of the year” for his work in Insolvency and Reorganization Law in Cape Town (2021).
